These Terms and Conditions (“T&C”) govern your access to and use of the website https://dietasexpress.com (the “Site”) and any related mobile applications or services (collectively, the “Platform”) operated by Dietas Express S. de R.L. de C.V., located at Av. Paseo de la Reforma 123, Piso 4, Col. Centro, C.P. 06000, Ciudad de México (the “Company”, “we”, “our” or “us”).

By accessing or using the Platform, you (“User”) accept these T&C in full. If you do not agree with any clause herein, you must refrain from using the Platform.

1. Definitions

Term Meaning

Account User profile created on the Platform.

Plan Digital nutrition plan generated by our AI from user‑supplied data.

Content All text, graphics, logos, images, videos, code and data on the Platform.

2. Eligibility

The Platform is intended for individuals 18 years or older. By creating an Account, you represent that you (a) are at least 18, (b) have legal capacity, and (c) will provide accurate, current and complete information.

3. Cookies

The Site uses cookies to personalise and enhance your experience. By using the Site, you consent to our use of cookies in accordance with our Cookie Policy.

Required cookies – essential for basic functionality (session, cart).

Analytics cookies – help us understand usage patterns (Google Analytics).

Marketing cookies – allow personalised ads (Meta Pixel).

You can manage preferences at any time via the cookie panel.

4. Intellectual Property ©

Unless otherwise noted, Dietas Express owns all intellectual‑property rights to the Content. You are granted a limited, non‑exclusive, revocable licence to access the Platform for personal, non‑commercial use only.

You must NOT:

Copy, reproduce or republish Content;

Sell, rent or sub‑license Content;

Frame or mirror any part of the Platform;

Use our trademarks without prior written consent.

5. User‑Generated Content (“Comments”)

The Platform may allow users to post reviews, comments or other material (“Comments”). We do not pre‑moderate Comments and reserve the right to remove any that are:

Defamatory, abusive or obscene;

Infringing third‑party intellectual property;

Promotional spam or unlawful solicitations.

By posting Comments, you grant the Company a worldwide, non‑exclusive, royalty‑free licence to use, reproduce and adapt such Comments in any media.

6. Linking to Our Site

The following entities may link to our homepage without written approval:

Government agencies;

Search engines;

News organizations;

Online directory distributors;

System‑wide accredited businesses (except non‑profit fundraising groups).

Other organizations must request approval via hola@dietasexpress.com. Links must not be deceptive, must not imply sponsorship/endorsement, and must fit the linking site’s context. We may revoke linking permission at any time.

7. Content Liability of Third‑Party Sites

We are not liable for content appearing on third‑party websites linking to or from the Platform. You agree to indemnify us against claims arising from content posted on your own site that links to our Platform.

8. Payments & Billing

Prices include VAT (IVA) and are listed in MXN unless stated otherwise.

Payments are processed securely via Stripe (PCI‑DSS Level 1).

Electronic invoices (CFDI) available upon request within the fiscal month.

9. Disclaimers

The Platform and Plans are provided “as‑is” and “as‑available”. We disclaim all warranties, express or implied, to the fullest extent permitted by law. Plans are not medical advice; always consult a healthcare professional.

Nothing in these T&C shall:

Limit or exclude liability for death or personal injury caused by negligence;

Limit or exclude liability for fraud or fraudulent misrepresentation;

Exclude liability not permissible under applicable law.

We are not liable for indirect or consequential loss arising from use of the Platform.

10. Modifications

We may revise these T&C at any time. Revised terms become effective upon posting. Continued use of the Platform constitutes acceptance of the changes.

11. Governing Law & Jurisdiction

These T&C are governed by the laws of the United Mexican States. Disputes shall be submitted to the competent courts of Mexico City, Mexico.
